Terms of Service

1. The Service
Boost Digital ("the Company") provides design, development, and deployment of websites and applications for service businesses in the Gulf region, per the selected package. The service includes:
- A complete website on a custom domain
- Admin panel + integration with declared payment gateways
- iOS and Android apps (Premium tier only)
- Delivery within the declared timeframe per tier (7-21 days)
- 3-day free trial before final payment
2. Payment & Refunds
- Payment: 50% upfront on start + 50% on launch
- No monthly subscription — one-time payment only
- Refunds available only during the 3-day trial period before the final payment
- After final payment, no refund requests will be accepted
3. Ownership & Client Rights
- Upon full payment, the client receives:
- — Source code of the website
- — Domain ownership registered in their name
- — All customer data (exportable as Excel or SQL)
- The client may migrate to any other hosting provider or developer after that
4. Support & Maintenance
- Basic: 2 months support
- Pro: 3 months support
- Premium: 5 months support
- Minor changes (text, images, prices, services) free during support period
- Major changes (new features) at a transparent price agreed before execution
- After support period ends, all modifications are paid at transparent rates
5. Limitation of Liability
The service is provided "AS IS" without any express or implied warranties. The Company shall NOT be liable — legally or financially — for any losses incurred by the client, whether direct or indirect, including but not limited to:
- Lost or projected profits
- Data loss or corruption (client is responsible for regular backups)
- Outages of cloud hosting (Vercel), databases (Supabase), or CDN
- Outages, failures, or delays of payment gateways (MyFatoorah, UTAP, Apple Pay, Google Pay, Tabby, Tamara, Postpay, or any other gateway)
- Rejection of client's app by Apple App Store or Google Play for any reason
- Client or staff misuse of the admin panel
- Security breaches resulting from client negligence in password protection
- Non-compliance with local laws (e.g. KSA's ZATCA, data protection laws, taxation, etc.)
- Content posted by the client that violates the law
- Any third-party interference (authorities, service providers, shipping companies, etc.)
The maximum liability of the Company — under any circumstances — is the total amount actually paid by the client for the package in question. The Company assumes no liability toward third parties such as the client's customers or partners.
6. Client Responsibilities
- Provide required content (text, images, logo, services, prices) within 48 hours of project start
- Review and approve each phase (design, development, launch) in writing
- Use the admin panel responsibly and not share passwords
- Comply with local data protection laws regarding customer data (GDPR, PDPL, etc.)
- Pay annual domain & hosting fees (~$100-160) directly to providers after year one
- Perform regular backups of customer data
- Disclose data collection to their own customers (their own privacy policy)
- Not use the site for any illegal purposes
7. Intellectual Property
- Custom UI/UX design: client property after payment
- Website source code: client property after payment
- Core templates and internal frameworks (Boost Digital framework): remain Company property
- Boost Digital brand, logo, and name: exclusive Company property
8. Termination
- Client may cancel during the 3-day trial without paying the final installment
- After launch, no ongoing obligation — client takes their property and parts ways
- If client breaches these terms, the Company may withdraw support and end the relationship
9. Governing Law & Disputes
- These terms are governed by the laws of the State of Kuwait
- Any dispute shall first be resolved amicably within 30 days
- Failing amicable resolution, the dispute shall be referred to the competent courts of Kuwait
10. Changes to Terms
The Company reserves the right to modify these terms at any time. Changes apply only to new contracts; existing contracts remain governed by the version in effect at signing.
